Welcome to FasaPay

By becoming FasaPay Member, you are deemed to have known and agreed to be bound by the Terms and Conditions issued by FasaPay. If you do not agree to these Terms and Conditions, you are expected to stop using FasaPay Member services. FasaPay Member services are only limited to customers who have a FasaPay personal account. FasaPay Member is fully responsible for the access and account password used. Violation of these Terms and Conditions is an illegal act based on applicable law and/or laws and regulations.

FasaPay appeal to FasaPay member so that pay attention to the following points:

Terms and Definitions

  1. "FasaPay" is a product engaged in the field of electronic money and fund transfers.
  2. "fasapay.com" is the domain name used to use FasaPay Membership Service.
  3. "Terms and Conditions" is a form of agreement between FasaPay Members and FasaPay which regulates the rights and obligations between the two parties who use FasaPay services.
  4. "FasaPay members" in using FasaPay services can serve as: Member Personal FasaPay or Merchant FasaPay.
  5. "Personal FasaPay" is an individual party that uses FasaPay services as a buyer/consumer from FasaPay Merchants.
  6. "Merchant FasaPay" is a company that uses FasaPay services as a seller, distributor or manufacturer.
  7. "FasaPay account" is the user identityservice FasaPay for the needs of FasaPay Members to access FasaPay services, sites and applications.
  8. "FasaPay balance" is the amount of funds stored in FasaPay Member's account.
  9. "Transaction" are all financial activities related to the member's FasaPay Balance, including and without exception: depositing funds (deposit), send funds (transfer), and withdraw funds (withdraw) available on the FasaPay website or application.
  10. "Data Transfer" is the data listed on the bank transfer, which contains the name, amount, news and other information from the sender of funds.
  11. "Password" is a combination of letters, numbers,and/or special character made by FasaPay Member to access FasaPay service, site, account and application and can be changed by FasaPay Member.
  12. "PIN (Personal Identification Number) FasaPay" is a personal identification number that is confidential and only known by FasaPay Members and must be included/entered by members when using FasaPay services. Together with FasaPay Account, password and the PIN is used to prove that the member concerned is entitled to FasaPay services on the FasaPay account.

FasaPay Registration

  1. In order to become a FasaPay Member, users must first register with the following conditions:
    1. Using a mobile phone number and an active email address;
    2. Every 1 (one) cell phone number and email address is only for one FasaPay Account;
    3. Every address email that has been registered for one FasaPay Account cannot be changed anymore;
    4. Activate through media provided by FasaPay from time to time but not limited to the FasaPay application.
  2. FasaPay members who have not registered identity data (not through KYC/Know Your Customer) on the FasaPay application will only get Registered status.
  3. FasaPay Members with Registered status can upgrade to Active and/or Verified status by registering personal data and uploading a photo of valid proof of identity (including a photo of National ID Card/Driver's License/Passport and a selfie holding the National ID Card/Driver's License/Passport identity) and upload other documents deemed necessary as required.
  4. FasaPay Members who have registered identity data and uploaded identity documents in the FasaPay application will become FasaPay Members with Active and/or Verified status if they have pass KYC process.
  5. The KYC verification process will take a maximum of 3(three) x 24 (twenty-four) hours.
  6. To fulfill the rules Customer Due Diligence (CDD), FasaPay may request additional information or documents from FaCustomer Due DiligencesaCustomer Due DiligencePay Members if needed according to applicable regulations.
  7. FasaPay has the right at its sole discretion for any reason to cancel and/or refuse the upgrade process from Registered to Active status.

Membership, Password and Security

  1. FasaPay account is a unique code and the authority to use it lies with FasaPay Member. FasaPay account is permanent.
  2. Membership Service is a service for providing the FasaPay system application which includes fund deposit transactions (deposit) and remittance (transfer) between accounts FasaPay member as well as withdrawal of funds (withdraw) to the FasaPay Member's bank account in accordance with limit transaction. Limit transactions have been determined based on FasaPay membership status. The intended membership status and transaction limit can be seen on the FasaPay official website https://www.fasapay.com/features/limit-fee/.
  3. FasaPay Member hereby declares that FasaPay Member is a person who can be responsible for all of his actions in accordance with applicable regulations.
  4. All FasaPay Members are exempted from FasaPay membership registration fee.
  5. FasaPay Members who act as sellers are advised to choose Merchant Membership Services, while FasaPay Members who act as buyers are advised to choose Personal Membership Services.
  6. FasaPay Member must provide true and accurate information, including but not limited to full name, address, telephone number, telephone number cell phone, address email and/or address website, bank account, and date of birth. If FasaPay Member provides incorrect, inaccurate or incomplete information, then FasaPay has the right to suspend or terminate FasaPay Member's account.
  7. If it is known and proven that the candidate or FasaPay Member fills in personal data and/or uses a false identity, then FasaPay has the right to freeze the account and the funds in it without prior approval.
  8. Accounts frozen by FasaPay, as explained in Article Membership, Password, and Security verse 7(seven) above can be reactivated with the following terms and conditions:
    1. Provide frozen personal data and account data.
    2. Upload the original identity and still valid.
    3. Provide and/or upload other necessary data.
    4. Account activation requests are sent via email use email registered and addressed to support@fasapay.com.
  9. FasaPay Member is responsible for maintaining account confidentiality and security password The FasaPay Member is fully responsible for all activities on behalf of the FasaPay Member account name.
  10. FasaPay members are responsible for maintaining confidentiality and security email personal.
  11. FasaPay Members are permitted to change or update their membership information regarding personal information and/or bank accounts at any time. FasaPay members are also permitted to close their membership permanently.
  12. Membership information changes can only be made via email and/or FasaPay Member's mobile number registered in the FasaPay system.
  13. FasaPay has the full right to limit, block, or terminate services from an account and take any action or legal steps if FasaPay considers FasaPay Members to violate applicable laws.
  14. FasaPay has the right to close the FasaPay Member's account either temporarily or permanently if fraud is suspected or not in accordance with the Terms and Conditions.
  15. FasaPay Member agrees that the process of becoming a FasaPay Member will only take effect after all the requirements requested by FasaPay are fulfilled by the member and the registration process has gone through an approved verification process.
  16. FasaPay Members are also not allowed to transfer accounts to other parties in any way without the knowledge and written approval of FasaPay. If the FasaPay Member violates this provision, all consequences and risks are entirely the responsibility of the FasaPay Member who switches the account.
  17. FasaPay urges FasaPay Members not to provide important data to other parties or parties acting on behalf of FasaPay whose security cannot be guaranteed.

Privacy Policy

  1. FasaPay guarantees the confidentiality of FasaPay Member from other parties. FasaPay will not sell, exchange, or send information provided by FasaPay Members to unauthorized third parties.
  2. FasaPay can submit information obtained from Fasapay Members, including but not limited to requests and/or orders by law, complying with applicable laws, from the authorities, central bank, or other state financial institutions.
  3. FasaPay Members may not use their membership for activities that violate international law, violate the rights of other parties or activities that are not in accordance with the FasaPay Terms and Conditions.
  4. FasaPay has the right to store FasaPay Member conversation data without prior approval from FasaPay Members.

Obligations and Rights

  1. Obligations of FasaPay Members
    1. FasaPay members are required to maintain the confidentiality of their identities.
    2. FasaPay Members are required to comply with the FasaPay Terms and Conditions.
  2. FasaPay Member Rights
    1. FasaPay Members have the right to guaranteed information confidentiality.
    2. FasaPay Members get the right to the smooth running of all FasaPay Transactions carried out according to FasaPay service hours.
    3. FasaPay Members get rights to Transaction services.
    4. FasaPay Members have the right to report Transaction history with the applicable provisions.
    5. FasaPay Member has the right to the security and guarantee of FasaPay Balance, including without limitation caused by negligence and malware.
  3. Based on the Obligations and Rights of FasaPay Members, then:
    1. FasaPay has the right to deactivate the misused account for further investigation without notification.
    2. FasaPay has the right to unilaterally freeze accounts deemed problematic.
    3. FasaPay is not responsible for illegal access to Fasapay Member accounts. All transactions that have been made cannot be returned. FasaPay Member fund transfers are guaranteed to be secure to their respective bank accounts.
    4. FasaPay never asks password/PIN FasaPay. Every FasaPay Member must maintain security password/PIN respectively by not giving it to others. FasaPay is not responsible for the loss of FasaPay Members due to misuse password/PIN.
    5. FasaPay considers that all members have agreed to indemnify for all claims, loss requests or damages (including attorneys' fees) made or incurred by third parties arising from or related to the use of services.
    6. FasaPay is not responsible for all transaction details between sellers and buyers or exchange of information between users of this site. Therefore, FasaPay is not responsible if the transaction or exchange of information is not appropriate and or legally defective or if there are legal consequences from transactions made through this site.
    7. FasaPay is not responsible for any consequences that occur during and after the transaction including if there is damage to the product or goods or services, warranty, incomplete parts, decreased value of the product or goods or services, as well as obligations and legal consequences that occur due to the Transaction.
    8. FasaPay does not make any statements or guarantees in connection with services and or performance of third party services; including but not limited to guarantees of eligibility merchant or fitness for a particular purpose.
    9. FasaPay is not responsible for members for incidental losses or consequences arising from violations of payments or contracts, delivery errors, delivery delays, shipments that are not in accordance with the conditions confirmed, use of services and/or products or any other breach of contract or obligations between FasaPay member.
    10. FasaPay has the right not to be involved in legal proceedings if misunderstandings between the parties concerned are resolved in stages and processed legally (if necessary).
    11. FasaPay is not responsible for misuse of transactions including but not limited to money laundering, purchase of prohibited goods, gambling, firearms, and financing of terrorism.
    12. FasaPay Member agrees to release FasaPay from all lawsuits that may arise from using FasaPay as a payment system online.

Transaction

  1. Information Required

    FasaPay will require the following information from FasaPay Members: full name, address, telephone number, email, website address, date of birth, and/or actual bank account.

  2. Transaction Information
    1. All transactions at FasaPay (funds deposit/deposit, fund transfer/transfer, fund withdrawal/withdrawal) that activate the Transaction PIN require verification to be sent to the email and/or cellphone number of each FasaPay Member.
    2. All FasaPay Members must pay attention to FasaPay service hours.
    3. FasaPay provides Transaction history for the last 6 (six) months. For requests for transaction history of more than the last 6 (six) months, FasaPay Members are required to submit a special request sent via email that has been officially registered in FasaPay Member's account.
  3. Depositing Funds (Deposits)
    1. FasaPay Members who deposit funds (deposits) are required to fill out the deposit form and send funds using the registered bank account number.
    2. FasaPay Member is required to include the information "Payment Voucher" and reference number (example: Payment Voucher TUxxxxxxxxxxxxx) in the column of transfer news for Transaction identification process.
    3. FasaPay members are requested to send funds using the full amount method.
    4. FasaPay is not responsible if the deposit is not processed due to:
      1. FasaPay Member does not make a deposit form in advance and does not include transfer information according to Article Transaction paragraph 3 (three) letters a and b.
      2. Data Transfer received does not match the deposit form made by FasaPay Member, (a new deposit will be processed if FasaPay receives confirmation from FasaPay Member).
    5. FasaPay has the right to request MT103 files from FasaPay Members for deposit processing purposes (if needed).
  4. Sending Funds (Transfers)
    1. The party sending the funds must ensure in advance the FasaPay Account of the intended recipient of funds to prevent errors in sending funds.
    2. FASAPAY IS NOT RESPONSIBLE FOR ALL TRANSACTIONS THAT ARE CONDUCTED BY THE FASAPAY ACCOUNT OWNER, which includes:
      1. Negligence

        Is an unintentional or intentional action carried out by the owner of the FasaPay Account (incorrectly entering the FasaPay Account and/or entering the wrong amount in the transaction).

      2. Use By Other Parties

        Is a FasaPay Account that is not used by the owner himself, including but not limited to hacking, use by friends, relatives and/or family.

  5. Withdrawal of Funds (Withdraw)
    1. FasaPay Members who withdraw funds are required to fill in the withdrawal form and withdraw funds according to the amount stated on the form.
    2. FasaPay members who withdraw funds are required to use personal bank data that is still active when filling out the withdrawal form. FasaPay will cancel the fund withdrawal transaction if the member's bank data does not match the data filled in the withdrawal form.
    3. FasaPay Members with Personal status have a monthly withdrawal limit of $25,000 (thirty five thousand US dollars). If the withdrawal of funds exceeds the predetermined limit, the withdrawal of funds will be canceled unilaterally by FasaPay.
  6. Special Data Requests
    1. FasaPay will process FasaPay Account Transaction mutation data requests submitted by FasaPay Members with a fee of $5 (five American dollars) for each Transaction mutation with a period of one year.
    2. FasaPay will process requests for bank SWIFT copy documents submitted by FasaPay Members with a fee of $25 (twenty five American dollars) for each document.
    3. FasaPay will process requests for data entry submitted by FasaPay Members for audit purposes with a fee of $25 (twenty five thousand US dollars) for each document.

Account Deactivation

  1. FasaPay has the right to deactivate FasaPay Accounts that have been inactive for 6 (six) consecutive months.
  2. FasaPay will freeze FasaPay Member's funds, if the FasaPay Member's account is not active for 6 (six) consecutive months in accordance with Article Account Deactivation verse 1 (one) and the FasaPay Member cannot be contacted by FasaPay in order to notify the refund with prior notification to the FasaPay Member for 3 (three) notifications for 30 (thirty) days.
  3. FasaPay Member Account which has been deactivated can be reactivated with the following conditions:
    1. Provide frozen personal data and account data.
    2. Upload the original identity and still valid.
    3. Provide and/or upload other necessary data.
    4. Requests for account activation are sent via email using the email registered and addressed to support@fasapay.com.
    5. Transaction history on a recently reactivated FasaPay Account cannot be recovered.

Contact, Customer Service and General Knowledge

  1. FasaPay provides FasaPay customer service, direct contact with customer service, and FasaPay official Skype to answer all questions from Members and/or prospective FasaPay members during FasaPay service hours.
  2. FasaPay members can send inquiries via form contact us outside of FasaPay service hours and will be replied at the next service hour.

Falsification of Identity/Unreal Identity

  1. FasaPay has full rights to approve and reject the verification process FasaPay member and if necessary FasaPay also has the right to ask for supporting data in the verification process.
  2. If it is known and can be proven that the candidate and/or FasaPay Member fills in false personal data and/or uses a false identity, then FasaPay has the right to freeze the account in it without prior approval.
  3. Account frozen by FasaPay as explained in article Falsification of Identity/Unreal Identity verse 2(two)above can be reactivated with the following terms and conditions:
    1. Provide frozen personal data and account data.
    2. Upload the original identity and still valid.
    3. Provide and/or upload other necessary data.
    4. Account activation requests are sent via email us email registered and addressed to support@fasapay.com.

Release of Claims

If a FasaPay Member has a dispute with one or more other members, FasaPay Member releases FasaPay (including the parent company, directors and employees) from claims and demands for damages and losses (actual and implied) of every kind and nature, known and unknown , arising out of or in any way connected with the dispute. Thus, FasaPay Member consciously and without pressure frees FasaPay from all kinds of demands.

Compensation

FasaPay Member will release FasaPay (including the parent company, directors and employees) from claims for damages and/or costs arising from any claims or demands, including reasonable legal fees, made by third parties that arise in the event that FasaPay Member violates the Terms and these provisions, improper use of FasaPay services and/or violation of the law by FasaPay members or third party rights.

Force Majeure

FasaPay Member will release FasaPay from all kinds of claims whatsoever and in whatever form, in the event that FasaPay is unable to carry out instructions from members either partially or wholly due to events or causes beyond FasaPay's power or ability, including but not limited to any interference computer virus or Trojan Horses or dangerous components that can interfere with FasaPay services, web browser or FasaPay computer system, members,Internet Service Provider, natural disasters, wars, riots, equipment, systems or transmissions that are not working, power failures, telecommunications disruptions, sabotage, mass strikes, government policies that prohibit FasaPay. provide banking system failure services as well as events or other causes beyond FasaPay's control or capability.

Dispute Resolution

  1. These Terms and Conditions are regulated and interpreted in accordance with applicable law.
  2. Any dispute arising from the implementation of these Terms and Conditions between Members (Personal) and FasaPay will be resolved by deliberation and consensus. If the dispute cannot be resolved by deliberation and consensus, the Member (Personal) and FasaPay agree to settle it exclusively in accordance with the applicable jurisdiction.
  3. In the event of a dispute between a Member (Personal) and a Third Party (including Merchant), then by referring to Article 3.7(three point seven) and 11.2(eleven point two) in these Terms and Conditions, Members (Personal) and Third Parties (including Merchant) agree not to involve and claim any responsibility from FasaPay because Members (Personal) and Third Parties (including Merchant) already know and agree that goods and/or services payments made using FasaPay services are not goods and/or services from FasaPay so that any disputes that arise between Members (Personal) and Third Parties (including Merchants) are not FasaPay's responsibility. FasaPay will only provide assistance as a payment system service provider including but not limited to providing transaction information and communication with disputing parties for the purpose of settling disputes.

Closing

By registering as a FasaPay Member, it means that you have agreed to these Terms and Conditions consciously and without coercion. These Terms and Conditions may change at any time without prior notification.
